EB-2 NIW does not cut wait for Indian nationals

The National Interest Waiver (NIW) allows individuals to self-petition for an EB-2 visa and bypass the U.S. Department of Labor (DOL) certification process required for traditional EB-2 petitions.
Traditional EB-2 petitions require employer sponsorships, prevailing wage determinations, and 18-to-24-month PERM labor certifications.
All EB-2 petitions, whether traditional or NIW, share the exact same per-country visa quota queue, so an NIW petition does not expedite green card issuance for Indian-born nationals.
The October 2026 Visa Bulletin lists the Final Action Date for EB-2 India as November 2013, creating a 12-to-13-year wait before filing Form I-485.
While Premium Processing can secure Form I-140 approval in 45 business days, the wait to file Form I-485 remains unchanged.
For Indian citizens, NIW provides job autonomy without corporate sponsor dependency, unlimited H-1B extensions, and early priority date porting toward future EB-1 petitions.
The National Interest Waiver allows Indian-born professionals to bypass employer sponsorship and labor certification, but it shares the standard EB-2 per-country quota queue and does not expedite green card availability.
